Warranty: your rights when a device fails
In France, every new purchase is covered for 2 years by the legal guarantee of conformity — whatever the brand, and on top of the manufacturer's warranty. Here's how it works, and the steps brand by brand.
Your legal guarantees (free, mandatory)
- Legal guarantee of conformity: 2 years from delivery, on any new purchase from a professional seller. Free and mandatory, it cannot be refused.
- Presumption of prior existence: a defect appearing within 24 months (new goods) is presumed to have existed since purchase — it's up to the seller to prove otherwise, not you.
- Guarantee against hidden defects: 2 years from the discovery of a hidden defect that makes the goods unfit for use (French Civil Code).
- Second-hand or refurbished goods: the legal guarantee applies too, with a 12-month presumption of prior existence.

Frequently asked questions
How long does the legal guarantee last in France?
The legal guarantee of conformity lasts 2 years from delivery, on any new purchase from a professional seller. It is free, mandatory, and adds to any commercial warranty.
Difference between the legal guarantee and the manufacturer's warranty?
The legal guarantee (conformity + hidden defects) is imposed by law, free, and enforceable against the seller. The manufacturer's warranty (commercial) is offered on top by the brand, with its own conditions; it never replaces the legal guarantee.
My device breaks down after 18 months — am I covered?
Yes, under the legal guarantee of conformity. A defect appearing within 24 months is presumed to have existed since purchase: it's up to the seller to prove otherwise, not you.
What should I keep to make a warranty claim?
The dated purchase invoice above all, then the serial number (or IMEI) and, if possible, the manual and packaging. Without proof of purchase, a warranty is hard to activate.
